Wireless, SMS & MMS Messaging Terms and Conditions

Please read these Wireless, SMS & MMS Messaging Terms and Conditions (the “Terms”) carefully. By providing your wireless, mobile and/or phone numbers to Lynden, you acknowledge and agree that:

  1. Lynden and/or any third-party service provider acting on its behalf (collectively, “Lynden”, “we” or “our”) may communicate with you at such numbers by wireless, mobile or phone call; Short Message Service (“SMS”) text message; Multimedia Message Service (“MMS”) text message; prerecorded artificial or voice messages; internet-to-phone message; voice over IP; voice message; or interactive voice recordings using autodial systems (“Communications”) regarding orders, delivery, route or status updates, requests for transactional feedback, and other informational purposes.
  2. Message, data, voice, or other rates may apply from your mobile phone service, wireless device carrier or landline carrier for Communications you send or receive. 
  3. For help, you may text HELP in response to an SMS or MMS text message or call (888) 596-3361.
  4. To opt-out of receiving further SMS or MMS text messages from Lynden, at any time you may send any of the following messages in response to an SMS or MMS text message:  STOP.  After sending one of these messages, you will receive one final SMS or MMS text message as confirmation of your opt-out request.  
  5. We may revise, modify, or amend these Terms, or any part thereof, at any time. Any such revision, modification, or amendment will be effective immediately upon posting to our website. You agree to review these Terms periodically to ensure that you are aware of any changes. Your continued consent to receive Communications after changes are posted shall be deemed to constitute acceptance by you of the Terms as revised, modified or amended by the posted changes.

You represent and warrant that you are the subscriber for the wireless, mobile, and/or phone numbers provided (or that you have the authority to agree to receive SMS or MMS text messages on the telephone number that you provided to us, or from which you sent the SMS or MMS request to us) and that you possess the phones or other devices associated with such numbers.

BY PROVIDING YOUR WIRELESS, MOBILE OR CELL PHONE OR TELEPHONE INFORMATION, YOU KNOWINGLY AND VOLUNTARILY AGREE TO INDEMNIFY, DEFEND, AND HOLD LYNDEN, ITS PARENT, SUBSIDIARIES, AFFILIATES, PREDECESSORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY “AFFILIATES”), AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, ADVISORS, ATTORNEYS, ADVISORS AND OTHER REPRESENTATIVES (“REPRESENTATIVES”), HARMLESS FROM AND AGAINST ANY AND ALL DAMAGES, FINES, PENALTIES, LOSSES, LIABILITIES, COSTS, CLAIMS, DEMANDS, COMPLAINTS, CAUSES OF ACTION, INJURIES, JUDGMENTS, COMPENSATION, ATTORNEY’S AND EXPERT’S FEES, AND EXPENSES OF ANY KIND (“DAMAGES”), INCLUDING WITHOUT LIMITATION ANY AND ALL TYPES OF DAMAGES SUFFERED BY YOU, WHICH ARISE AS A RESULT OF, IN CONNECTION WITH OR RELATED TO ANY OF THE COMMUNICATIONS. YOU KNOWINGLY AND VOLUNTARILY AGREE NOT TO SUE, OR CAUSE (DIRECTLY OR INDIRECTLY) ANY LAWSUIT, COMPLAINT, CLAIM, OR CHARGE TO BE FILED ON YOUR BEHALF AGAINST LYNDEN OR ITS AFFILIATES OR ANY OF ITS OR THEIR RESPECTIVE REPRESENTATIVES WITH RESPECT TO ANY SUCH DAMAGES.

Lynden (including without limitation its Affiliates and its and their Representatives), is not responsible for and will not be liable for any special, incidental, punitive or consequential damages, including, without limitation, attorneys’ fees and loss of profits or income, whether or not Lynden had knowledge that such damages might be incurred, relating to its short codes or any of its texting OR OTHER services.  THE TEXTING AND OTHER SERVICES ARE PROVIDED ON AN “AS IS”, “WHERE IS”AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER STATUTORY, EXPRESS, IMPLIED OR OTHERWISE.

You agree that:

  • you will to promptly notify Lynden if your wireless, mobile, and/or phone numbers change or you no longer possess any of the phones or other devices associated with such numbers;
  • SMS and MMS messaging is not available in all areas;
  • not all mobile or other devices may be supported;
  • Lynden (and its Affiliates and its and their Representatives) and the carriers are not and will not be liable for delayed or undelivered messages;
  • Lynden (and its Affiliates and its and their Representatives) are not liable for any messaging fees, data charges or other charges charged by your carrier for your use of the services or for any other loss or damage which may be caused by your use of the services or for any service delay or failure or for any message receipt or delivery delays or failures; and
  • you will not sue Lynden as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against Lynden (nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff).

Wireless carriers are not responsible for delayed or undelivered messages, which may occur due to factors outside such carriers’ control.
